1) Acceptance of these Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Mightyfitness mobile application (the “App”) and any related services we provide (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

3) Eligibility

The Service is intended for a general audience, but it is not directed to children under 13. If you are under 13, do not use the Service.

If you are 13–17, you may use the Service only with the consent and involvement of a parent or legal guardian to the extent required by applicable law.

4) Accounts and security

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us.

5) Fitness and health disclaimer

The Service is for informational and tracking purposes only and does not provide medical advice. Consult a physician or qualified healthcare professional before beginning any exercise program. Stop exercising and seek medical attention if you experience pain, dizziness, or other concerning symptoms.

You acknowledge and agree that exercise involves risk of injury and you assume all risks associated with your use of the Service.

6) Your content (including photos)

The Service may allow you to create or upload content such as workouts, routines, notes, measurements, and photos (“User Content”). You retain ownership of your User Content.

You grant Mightyfitness a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your User Content only as needed to operate and improve the Service.

You are responsible for your User Content and represent that you have the rights to provide it and that it does not infringe the rights of others or violate the law.

7) Acceptable use

• Do not use the Service for unlawful, harmful, abusive, or deceptive purposes.
• Do not attempt to access, probe, or disrupt our systems or other users’ accounts.
• Do not upload malware or exploit vulnerabilities.
• Do not copy, modify, distribute, sell, or lease any part of the Service except as permitted by law or by us in writing.

8) Intellectual property

The Service (excluding User Content), including its design, text, graphics, logos, and software, is owned by Mightyfitness and protected by applicable laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms.

9) Third-party services

The Service may use third-party services for features such as authentication, analytics, and data storage. Your use of third-party services may be subject to their terms. We are not responsible for third-party services outside our control.

10) Changes to the Service and Terms

We may update the Service and these Terms from time to time. Updates will be posted on our website or in the Service. Your continued use after changes take effect means you accept the updated Terms.

11) Termination

You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, your use creates risk or legal exposure, or we are required to do so by law.

12) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.

13) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIGHTYFITNESS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

14) Indemnity

You agree to defend, indemnify, and hold harmless Mightyfitness from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable laws.

15) Governing law

These Terms are governed by the laws of Georgia (excluding conflict-of-law rules). Any dispute arising from or relating to these Terms or the Service will be brought in the competent courts of Georgia, unless mandatory law provides otherwise.
